Chapter 7 - Emma Finds Her Voice

Preparing Emma for testimony took weeks.
The defense would challenge her memory.
Her decisions.
Why hadn't she left earlier?
Why hadn't she reported earlier incidents?
Why did she remain married?
Emma hated those questions.
“They make it sound like staying means I agreed.”
“No,” the prosecutor said. “They want the jury to wonder. Your job is simply to tell the truth.”
Trial began on a cold Monday morning.
Daniel entered in a navy suit.
Emma didn't look at him.
Rachel testified first.
Then Julia.
Then officers.
Then doctors.
Then digital-forensics experts.
The recordings were played.
The courtroom heard Daniel's voice change when nobody else was around.
Polite in public.
Controlling in private.
When Emma finally took the stand, Daniel looked directly at her.
She noticed.
Then looked at the jury instead.
She told them about passwords.
Isolation.
Apologies.
Fear.
The hidden cameras.
The suitcase.
The locked bedroom.
The old phone.
Then came the call.
“Why did you call your sister?”
Emma paused.
“Because I thought if I didn't call somebody that night, I might never get another chance.”
The defense attorney stood.
He was professional but relentless.
“You love your sister?”
“Yes.”
“And she's a police officer?”
“Yes.”
“You knew involving her would create serious consequences for your husband.”
“I knew involving her might get me out of the room.”
“Mrs. Mercer, isn't it true you and your husband argued frequently?”
“Yes.”
“You yelled?”
“Sometimes.”
“You threw things?”
“Once I threw a coffee mug into the sink.”
“So you could become angry.”
Emma looked at him.
“Yes.”
The attorney seemed pleased.
Then Emma continued.
“Being angry doesn't give someone permission to hurt you.”
Silence.
The attorney moved on.
He questioned the cameras.
Why hide them?
Emma answered simply.
“Because every morning Daniel told me the night before hadn't happened the way I remembered it.”
That answer stayed with the jury.
Later, Daniel testified.
Against his attorney's apparent preference.
He said Emma exaggerated.
He said Rachel resented him.
Julia was ashamed of their affair.
Melissa had disappeared because she was unstable.
Claire hated him.
His mother was confused.
One by one, every woman in his life became the problem.
The prosecutor noticed.
“So everyone is lying?”
Daniel shifted.
“I didn't say everyone.”
“Which witness told the truth?”
Daniel couldn't answer.
Then the prosecutor played the recording.
At 2:51 a.m., Daniel's voice filled the courtroom.
At 3:05, Emma reached the hidden phone.
At 3:07:
“Come pick me up… my husband…”
Daniel looked down.
For the first time, Emma looked directly at him.
And she realized something.
He looked smaller.
Not because he had changed.
Because she had.
The jury began deliberations.
Three hours passed.
Then four.

At 6:42 p.m., the courtroom deputy entered.
“We have a verdict.”
